Vuepak acceptable use policy
At Vuepak we strive to do our best to care for our valued customers.
As a customer you agree to comply with Vupak’s Terms and Conditions of Use , Privacy Policy and abide by this Acceptable Use Policy. We trust that you will use our products and services responsibly.
In order to adhere to various state, federal, international laws, and our own policies, Vuepak prohibits the use of our website or any of our Services by any person or organization that:
Content and Communication Restrictions
- Posts, displays or markets any material that exploits children under 18 years of age.
- Posts or discloses any personally identifying information or private information about anyone without his or her consent, including children under 18 years of age without their parent's consent.
- Engages in identity theft, doxing, revenge content, or unauthorized collection of personal information.
- Posts, displays or markets any material depicting animal abuse, cruelty, harm, killing, or suffering, including but not limited to content showing animals being hurt, tortured, killed, or experiencing pain in any natural, domestic, or artificial environment. This includes hunting or other activities that result in intentional animal harm or death, regardless of legality in the jurisdiction where such activities occur. Fishing content is permitted provided it does not depict gratuitous cruelty or suffering.
- Provides or posts any material that is grossly offensive, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity or that is obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable.
- Posts, displays or markets pornography or adult sexual products, including but not limited to adult magazines, video and software, escort services, dating services, or adult "swinger" promotions.
- Provides instructions on how to assemble or otherwise make bombs, grenades or other weapons.
- Engages in any libelous, defamatory, scandalous, threatening, or harassing activity.
- Posts or displays any content, including any image, that infringes, misappropriates or otherwise violates the intellectual property rights of others, including but not limited to authors, artists, photographers, videographers or film makers.
- Provides or posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or that provides instruction, information or assistance in causing or carrying out such violence.
- Promotes, supports, or facilitates terrorist organizations, terrorist activities, or any content that could be used to recruit for or coordinate terrorist activities.
Illegal Activities and Products
- Sells or promotes any products or services that are unlawful in the location at which the content is posted or received.
- Sells or promotes illegal drugs and contraband that are unlawful in the location at which the content is posted or received.
- Sells illegal goods, pirated software or media.
- Promotes or facilitates financial fraud, Ponzi schemes, pyramid schemes, cryptocurrency scams, or unauthorized investment services.
- Provides unauthorized financial, legal, or medical advice or services without proper licensing.
- Promotes unproven medical treatments, unauthorized pharmaceuticals, or makes false health claims.
AI-Generated Content Restrictions
Users are solely responsible for the accuracy, legality, and appropriateness of AI-generated content they create or distribute through the Services. Vuepak disclaims all liability for harm caused by such content and reserves the right to suspend or terminate access if it violates any law or policy. Users must review all AI-generated content before use and ensure compliance with applicable laws and this Acceptable Use Policy.
- Uses AI-generated content to create harmful, misleading, or inappropriate material.
- Attempts to generate content that violates intellectual property rights or impersonates real individuals without consent.
- Creates AI content that promotes illegal activities, hate speech, or violates any other provision of this policy.
- Uses AI features to generate spam, deceptive content, or material that circumvents content moderation systems.
- Creates deepfakes, AI-generated impersonations, or other synthetic media designed to deceive or harm others.
- Uses AI-generated content to spread misinformation, false claims, or manipulated information.
Platform Security and Technical Abuse
- Introduces viruses, worms, Trojan horses, spyware or other harmful code.
- Probes, scans, or tests the vulnerability of any system or network.
- Breaches or otherwise circumvents any security or authentication measures.
- Attempts to access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to.
- Interferes with or disrupts any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services.
- Attempts to access or search the Services by any means other than our publicly supported interfaces (for example, "scraping").
- Abuses the Services in a manner that circumvents their storage space or streaming limits.
- Uses automated or other means to create accounts in bulk or to access the Services other than by using our official interface and/or APIs.
- Engages in competitive intelligence gathering, corporate espionage, or unauthorized data harvesting for business advantage.
Vuepak Platform-Specific Restrictions
- Manipulates engagement metrics or analytics through artificial means.
- Shares inappropriate content through Packages (multimedia presentations) or other platform features.
- Abuses automation features (Sequences) to harass or spam recipients.
- Misuses reseller privileges or shares inappropriate content with authorized Resellers.
- Uses Time Zone IQ or other platform features to circumvent recipient preferences or legal restrictions.
- Sells the Services or Services accounts via unauthorized channels.
- Creates fake reviews, testimonials, or engages in astroturfing or coordinated inauthentic behavior.
- Shares account credentials or violates subscription terms through unauthorized account sharing.
- Engages in subscription fraud or payment manipulation.
- Abuses third-party integrations or uses integrations to bypass platform rules.
- Fraudulent use of affiliate/referral systems, including self-referrals or referral loop exploitation, is prohibited.
Email and Communication Compliance
Users are responsible for all activity conducted via any email account connected to Vuepak, including Gmail or other integrated providers. While email delivery may occur through third-party infrastructure, misuse of Vuepak's tools, including to send misleading, deceptive, harassing, or unsolicited messages, is prohibited and may result in account suspension or termination. Such misuse may also violate the terms of service of the connected email provider, for which users are independently responsible.
- Fails to provide an opt out method in any commercial message or fails to comply with a request by a recipient not to be contacted.
- Fails to include a valid physical mailing address on messages.
- Sends emails from a fictional identity or uses a pseudonym, assumed identity or alias.
- Attempts to disguise the email origin or falsifies or manipulates email headers or transmission path.
- Sends communications that violate anti-spam laws, including emails without proper opt-out mechanisms, or content that constitutes illegal spam or phishing.
- Sends altered, deceptive or false source-identifying information, including "spoofing" or "phishing".
Compliance and Legal Restrictions
Sanctions and Export Control Compliance: You may not use the Services if you are a restricted person under U.S. sanctions, export control laws, or other applicable legal restrictions, including those listed on OFAC's Specially Designated Nationals List or other government watch lists.
Data Protection Compliance: You must comply with all applicable data protection and privacy laws, including GDPR, CCPA, and other regional privacy regulations when using our Services. This includes obtaining proper consent, providing required notices, and honoring data subject rights.
Age Restrictions: Individuals under 18 years of age are prohibited from using the Services, as specified in our Terms of Service.
Spam Prevention
We are committed to preventing spam related abuse. This is why you may only use Vuepak to send emails and SMS/text messages to people and entities that either:
- Gave you written (including electronic) permission to message them, have not withdrawn that permission, and gave you that permission in the past 12 months.
- Did not object to promotional content you sent them in the past 12 months.
- Gave you their name and email address or mobile number in connection with a purchase, or negotiations to purchase, a product or service from you, have not opted out from receiving your messages, and either purchased something from you or negotiated a purchase from you in the past 12 months; or didn't object to promotional content you sent them in the past 12 months.
- Are business contacts obtained through legitimate business contact providers (such as ZoomInfo, Lusha, or similar services) for business-to-business communications, provided you comply with applicable laws and maintain proper opt-out mechanisms.
Important: You are solely responsible for ensuring that your use of any contact lists, whether directly obtained or purchased from third-party providers, complies with all applicable anti-spam laws, including CAN-SPAM, CASL, GDPR, and other relevant regulations in your jurisdiction and the recipients' jurisdictions.
SMS/Text Messaging Additional Requirements
For SMS/text messaging through our Services:
- Additional compliance with A2P 10DLC requirements and carrier guidelines is required for messages to US numbers.
- You must comply with TCPA (Telephone Consumer Protection Act) and other applicable telecommunications laws.
- International SMS must comply with local regulations including GDPR and Canada's Anti-Spam Legislation (CASL) where applicable.
- Time Zone IQ and other platform features must be used responsibly and in compliance with applicable laws.
If you send emails or text messages to a list and you get an unusual amount of SPAM complaints, ISPs and carriers will start blocking messages from your organization. They may also ask Vuepak to shut down your account. So if you don't have proof that every recipient on your list opted-in to receive your messages, or otherwise meets the requirements listed above, then please don't import the contact information into Vuepak.
Best Practices
The following are some steps you can take to avoid accidentally becoming a spammer:
- Sending your first campaign to an old list. Some recipients may not remember you, and they could report you for spamming. It is good to remind them who you are and how they got on your list.
- If you are importing from a CRM, break your list into separate segments or interest groups so you can send relevant content to your customers. It is not recommended to just mix different lists together and send one mass email or text message to everyone at once.
- If you are sending on behalf of clients, it is advised that you educate them about responsible email and text message marketing.
- Before importing a list into Vuepak from your CRM or another database, read and understand our Terms and Conditions of Use. Remove any prospects or leads that did not request marketing messages from you or otherwise meet the requirements in our Terms.
- Always provide opt-out mechanisms. Even if you are sending marketing messages to customers that consented to receive your communications, you are still required by law to allow them to opt out of your marketing list.
- Review AI-generated content before sending to ensure it is accurate, appropriate, and complies with applicable laws and this policy.
Enforcement
In the event that you engage in any of the activities listed above, in our sole discretion, we reserve the right to terminate your access to or use of our Services, disable your Vuepak account or access to our Services, and remove all or a portion of your content, in each case at any time, with or without notice and without refund. We may, in our sole discretion, also report your activity to the applicable legal authorities or third parties for abuse or fraud prevention. In addition, Vuepak reserves the right to prohibit the use of Vuepak's Services by any company or site in its sole discretion.
